Online Gaming & Gambling: Navigating Compliance in a Multi-Jurisdictional World
September 23, 2025
The online gaming industry has evolved rapidly, driven by technological innovation and increasing global interest. But with opportunity comes complexity—especially when it comes to compliance.
At Lazarus Legal, we’ve been at the forefront of gaming law for over 20 years, helping clients navigate the intricacies of licensing and regulatory requirements across jurisdictions. Whether you're launching a new platform or expanding into new markets, understanding the legal landscape is critical.
The Rise of Multi-Jurisdictional Licensing
Gone are the days when a single gaming license could unlock global access. Today, operators must comply with local laws and licensing regimes in each jurisdiction they wish to serve. For example, in Canada, online gambling is regulated at the provincial level, with each jurisdiction having the authority to conduct and manage gaming activities under Section 207 of the Criminal Code. Ontario has established a regulated market for private operators through iGaming Ontario (iGO) and the Alcohol and Gaming Commission of Ontario (AGCO).
Foreign operators do not need to be physically established in Canada to participate. However, they must:
- Register with the AGCO;
- Sign an Operating Agreement with iGO; and
- Comply with the Registrar’s Standards for Internet Gaming.
Players must be physically located in Ontario to access these platforms, regardless of their residency status.
Strategic Licensing Jurisdiction
To simplify compliance, many operators choose jurisdictions known for their streamlined processes, such as:
- Kahnawake (Quebec) – Known for its efficient licensing and strong compliance programs.
- Tobique First Nation (New Brunswick) – Offers multijurisdictional licensing with post and pre-license issuance support.
- Malta, Isle of Man, Alderney – European jurisdictions with robust regulatory frameworks and tax advantages.
Each jurisdiction has its own advantages and disadvantages, and selecting the right one depends on your business model, target markets, and operational requirements.
Compliance Is Not Optional
Operators must demonstrate financial stability, consumer protection measures, and anti-money laundering protocols. Failure to comply can result in fines, license revocation, or reputational damage.
At Lazarus Legal, we offer:
- Guidance on obtaining online gaming licenses
- Corporate structuring and jurisdiction selection
- Legal opinions and regulatory analysis to ensure compliance
- Support with payment processors and banking solutions
